For Filipino Sellers — Tax Questions Answered
Can I sell on SariKo as a Filipino living in Vietnam?
Yes — absolutely. Whether you are on a tourist visa, temporary residence card (TRC), work permit, or permanent residence card, you are fully eligible to sell. You do NOT need a Vietnamese business license.
What are my tax responsibilities?
If your total annual SariKo sales are below 100,000,000 VND (~USD 4,000 / PHP 220,000), you pay zero tax in Vietnam. SariKo only reports your revenue to the Vietnam tax authority — nothing is withheld from your payout.

Above that threshold: SariKo automatically withholds 1% for goods (imported products, dry goods) or 2% for services (lutong bahay, tutoring, caregiving, tailoring) from each payout. This withholding IS your personal income tax as an individual seller under Circular 40/2021, it is not a second, separate tax on top of it. You receive an annual certificate. No separate filing needed.
What about Philippine taxes (BIR)?
If you are a Philippine citizen earning income abroad, you may have BIR reporting obligations depending on your residency status. We recommend consulting a Philippine accountant if your SariKo earnings are significant.

Why Am I Paying These Fees?

A fee is not a tax on your money. It is payment for the infrastructure that makes the sale possible and safe in the first place, the same reason a toll road charges for passage: not for your car, but for the road under it. Think of SariKo like a covered stall inside a real palengke, not a folding table on the sidewalk. Selling on Messenger or Viber is free, but you are on your own: no buyer protection, no new customers finding you, no trust signal for strangers. SariKo's fees pay for the market around your stall.

Your subscription (fixed, monthly) pays for your storefront, your place inside the SariKo marketplace, your dashboard, and priority support.
Your commission (only when you sell) pays for verified buyers, secure VNPay payment processing with gateway fees absorbed by SariKo, delivery coordination, and marketing that brings new buyers to you at no extra cost. No sales in a month means no commission that month.
Founding Sellers (the first 50) get 3 months of subscription free and commission locked at 17% forever, never subject to future increases, so you can feel the full value of SariKo before you pay anything and know exactly what you'll pay for good.

Seller Agreement v1.1 — Key Terms

1. Who you are contracting with

Zen Tech Asia Co., Ltd. (MST 0316852554), operating SariKo at sariko.store. Contact: poppet@sariko.store.

2. Commissions and payouts

Community: 19% · Tindahan: 17% · Negosyo: 15% · Enterprise: 15%. Founding Sellers (first 50): 3 months of subscription free, and commission locked forever at 17% or your tier's standard rate, whichever is lower, so Negosyo and Enterprise Founding Sellers keep their 15%. Payment gateway fees (VNPay) are absorbed by SariKo. Payouts processed weekly every Wednesday for the prior week's settled orders.

3. Your requirements as a seller

List only legally saleable goods/services. Provide accurate descriptions and VND prices. Comply with Vietnam food safety regulations. Respond to new orders within 4 hours. Do not solicit buyers off-platform. Do not create multiple accounts without permission.

4. Taxes — Filipino sellers in Vietnam (Circular 40/2021)

Below 100,000,000 VND annual sales: EXEMPT — no withholding, no filing needed. Above 100,000,000 VND: SariKo automatically withholds 1% (goods) or 2% (services) from each payout and remits to Vietnam's General Department of Taxation. SariKo reports all seller annual revenue to GDT regardless of income level. You may also have Philippine BIR obligations — your responsibility.

5. Your identity and data

By registering, you consent to SariKo collecting your identity documents, contact details, payout account information, and transaction records for: operating your account, processing payouts, and legal tax reporting obligations under Circular 40/2021 and Decree 13/2023.

6. Dispute resolution and governing law

Buyer-seller disputes: SariKo mediates within 72 hours. SariKo-seller disputes: VIAC arbitration in Ho Chi Minh City, English language. Governing law: Socialist Republic of Vietnam.

7. Termination

You may close your account anytime. SariKo may terminate with 14 days' notice, or immediately for fraud or material breach. All payouts owed for completed orders are always remitted.
